TopFlight Beta – Terms and Conditions

Please read these Terms and Conditions carefully before using the TopFlight beta web application. By accessing or using the application, you agree to be bound by them. If you do not agree, do not use the application.

1. Who we are

TopFlight is operated by TopFlight.fun. References to "we", "us" and "our" in these terms are references to TopFlight.fun.

2. The beta product

The TopFlight application is currently provided as a beta product. This means:

It is an early, experimental version of the software, released for testing purposes only.
It uses play money only. No real currency, cryptocurrency or financial asset of any kind is used, earned, staked or lost through the beta application.
It may contain bugs, errors or inaccuracies. Features may be incomplete, changed or removed at any time without notice.
We do not guarantee continuous availability. The application may be taken offline, reset or altered without prior warning.
Data, balances and positions recorded during the beta may be wiped at any time and will not carry forward to any future version of the product.

3. Eligibility

To use TopFlight beta you must:

Be at least 18 years of age.
Be accessing the application for personal, non-commercial purposes.
Not be prohibited from doing so under the laws of any jurisdiction that applies to you.

By using the application you represent and warrant that you meet these requirements.

4. Not financial advice or a regulated product

TopFlight beta is a demonstration and testing environment. Nothing on the application constitutes financial advice, investment advice, or a recommendation to buy, sell or hold any asset. No element of the beta product is a regulated financial instrument. We are not authorised or regulated by any regulatory body in respect of the beta product.

If you are in any doubt about financial matters, you should seek independent professional advice.

5. Risks

By using TopFlight beta you acknowledge the following:

Smart contract risk. The underlying protocol relies on smart contracts deployed on a blockchain. Smart contracts may contain bugs or vulnerabilities and cannot be reversed once executed. Although the beta uses play money, you should be aware of this risk in any future live version of the product.
Blockchain risk. Blockchain networks can experience congestion, forks, failures and other disruptions outside our control.
Software risk. Beta software is inherently unstable. You may encounter unexpected behaviour, data loss or downtime.
No returns. Play money balances have no monetary value. There is no expectation of any financial return from participating in the beta.
Third-party services. The application may rely on third-party data providers, oracles and infrastructure. We are not responsible for failures in those services.

6. Your account and conduct

You are responsible for maintaining the security of any wallet or account credentials you use to access the application. You must not:

Attempt to circumvent, manipulate or exploit the application or its underlying smart contracts.
Use the application for any unlawful purpose.
Introduce malware, conduct denial-of-service attacks or otherwise interfere with the application or its infrastructure.
Misrepresent your identity or eligibility.

We reserve the right to suspend or terminate your access at any time if we believe you have breached these terms or are misusing the application.

7. Intellectual property

All intellectual property rights in the TopFlight application, its design, code and content are owned by or licensed to TopFlight.fun. You are granted a limited, non-exclusive, non-transferable licence to use the application for personal testing purposes during the beta period. You may not copy, modify, distribute or create derivative works from any part of the application without our prior written consent.

8. Limitation of liability

To the fullest extent permitted by applicable law:

We provide the beta application on an "as is" and "as available" basis, without warranties of any kind.
We are not liable for any loss or damage arising from your use of the application, including loss of data, loss of play money balances, downtime or any errors in the application.
Our total liability to you in connection with these terms, however arising, shall not exceed $100.

9. Changes to these terms

We may update these terms at any time. If we make material changes we will notify you via the application or by email where we hold your contact details. Continued use of the application after changes take effect constitutes acceptance of the revised terms.

10. Termination

We may terminate or suspend the beta programme at any time and for any reason. These terms will cease to apply when your access ends, except for provisions that by their nature survive termination (including clauses 7 and 8).
